Terms of Service for Brim

Welcome to Brim. By downloading or using the Brim app (the "App" or "Service"), you agree to these terms. If you do not agree, please do not use the App.


1. Service Provider

Brim is developed and maintained by Lazare Kolebka, an individual operating in Brussels, Belgium.

2. Description of Service

Brim is a personal budgeting and financial management application for iOS that helps you:

  • Track income and expenses
  • Set and manage budgets
  • Create recurring transactions
  • Analyze spending patterns
  • Receive AI-powered financial insights
  • Sync your data across your Apple devices via iCloud

Brim is designed for personal, non-commercial use. Your financial data is stored locally on your device and in your personal iCloud account. We do not have access to, nor do we collect, store, or share your financial data.


3. Eligibility

Age Requirements

The Service is not directed to children under the age of 13. Users must be adults according to their applicable legislation. Minors may use this Application only with the assistance of a parent or guardian. Under no circumstances may persons under the age of 13 use this Application.

Account Requirements

To use Brim, you must:

  • Have a valid Apple ID
  • Sign in using Apple Sign-In or Google Sign-In
  • Provide accurate information during registration
  • Maintain the security of your account credentials

4. License and Restrictions

Grant of License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Brim on your personal Apple device(s) solely for your personal, non-commercial use.

Restrictions

You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  • Modify, adapt, translate, or create derivative works based on the App
  • Sell, rent, lease, sublicense, distribute, or otherwise transfer the App or your rights under this license
  • Use the App for any commercial purpose without our express written consent
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notice
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to the App, our systems, or other users' accounts
  • Use automated systems or software to extract data from the App
  • Interfere with or disrupt the Service or servers or networks connected to the Service

5. Account Management

Account Creation

When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access or security breach
  • Accept responsibility for all activities that occur under your account

Account Termination

You may delete your account at any time through the App settings (Settings → Account → Delete Account). Upon account deletion:

  • Your local financial data will be immediately deleted from the App
  • Your iCloud data will be deleted through sync
  • Your authentication records and profile information will be deleted
  • Certain data may be retained as described in our Privacy Policy for legal, accounting, or security purposes

We reserve the right to suspend or terminate your account if you violate these Terms.


6. Subscription and Payments

Subscription Service

Brim operates on a subscription basis. All subscriptions are processed and managed by Apple through the App Store's In-App Purchase system. Current pricing is displayed in the App Store and within the App, and may vary by region.

Important: We reserve the right to modify subscription prices at any time. For existing subscribers, we will provide at least 30 days' advance notice of any price increase. Your continued use of the Service after a price change constitutes acceptance of the new pricing.

Payment Processing

All payments are processed by Apple, not by us. We do not collect, process, or store your payment information. Your payment relationship is with Apple, and you must comply with Apple's payment terms.

Auto-Renewal and Cancellation

Your subscription will automatically renew unless you cancel at least 24 hours before the renewal date. You may cancel your subscription at any time through:

  • iOS Settings → [Your Name] → Subscriptions → Brim
  • The Brim app: Settings → Subscription → Manage Subscription

Cancellation prevents future charges but does not provide a refund for the current subscription period. You will retain access to subscription features until the end of your current billing period.

Refunds

All refund requests must be directed to Apple, as they process all payments. We cannot issue refunds directly.

To request a refund from Apple:

  • Visit https://reportaproblem.apple.com
  • Or use the App Store application on your device

Apple's refund policy applies to all purchases. If you experience technical issues or are unsatisfied with the Service, please contact us at hello@getbrim.app before requesting a refund so we may attempt to resolve the issue.

Free Trials

We may offer free trial periods at our discretion. Trial terms will be clearly disclosed at the time of sign-up. If you do not cancel before the trial period ends, you will be automatically charged for a full subscription.


7. Data Ownership and Privacy

Your Content

You retain all ownership rights to any data, information, or content you input into the App, including but not limited to transactions, budgets, categories, notes, and custom settings (collectively, "Your Content"). You grant us no rights to Your Content.

Data Storage and Access

  • Stored locally on your device using Apple's SwiftData framework
  • Optionally synchronized to your personal iCloud account (if you enable this feature)
  • Encrypted during transmission and storage
  • Never transmitted to our servers
  • Never accessible by us or any third parties (except as provided by you through your use of Apple services)

Our Limited Data Collection

The only data we collect is limited to authentication and analytics information as specifically described in our Privacy Policy, available at https://getbrim.app/privacy. We do not collect, access, or process your financial data.

Data Backup and Responsibility

Your Responsibility:
You are solely responsible for maintaining appropriate backups of Your Content. We strongly recommend enabling iCloud synchronization to protect against data loss.

Our Responsibility:
While we implement reasonable measures to prevent data loss, we are not responsible for any loss of Your Content resulting from:

  • Device failure, loss, theft, or damage
  • Operating system updates or incompatibilities
  • iCloud synchronization issues (managed by Apple)
  • User error, including accidental deletion
  • App uninstallation or account deletion
  • Any other cause beyond our reasonable control

Data Export:
You may export Your Content at any time through Settings → Data → Export Data.


8. Third-Party Services

Brim integrates with the following third-party services:

Apple Services

  • iCloud CloudKit: For optional data synchronization across your devices
  • Sign in with Apple: For authentication
  • In-App Purchases: For subscription management
  • Apple Intelligence: For on-device AI-powered insights

Your use of Apple services is subject to Apple's terms and conditions.

Other Third-Party Services

  • Firebase Authentication (Google): For account management and authentication
  • RevenueCat: For subscription infrastructure management
  • PostHog: For anonymized analytics (as described in our Privacy Policy)

Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices, policies, or actions of any third-party service providers.


9. Intellectual Property Rights

The App, including but not limited to its software code, algorithms, user interface design, visual design, graphics, text, documentation, and all associated intellectual property rights, is owned by Lazare Kolebka and is protected by copyright, trademark, and other intellectual property laws.

"Brim" and the Brim logo are trademarks of Lazare Kolebka. You may not use these trademarks without our prior written consent.


10. AI-Powered Features

Apple Intelligence Integration

Brim utilizes Apple Intelligence (Apple's on-device artificial intelligence system) to provide:

  • Contextual spending insights
  • Budget performance analysis
  • Financial pattern recognition
  • Personalized recommendations

Privacy Notice:

  • All AI processing occurs entirely on your device
  • Your financial data is never transmitted to Apple's servers or our servers for AI processing
  • Neither Apple nor we have access to your data during AI processing
  • You may disable Apple Intelligence features through iOS Settings

AI Disclaimers

AI-generated insights and recommendations are provided for informational purposes only and should not be considered professional financial, investment, tax, or legal advice. These features may contain errors, are based solely on data you've entered, and may not be suitable for your specific situation. You are solely responsible for your financial decisions. Always consult qualified professionals before making significant financial decisions.


11. Disclaimer of Warranties

The App and Service are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

We do not warrant that:

  • The App will meet your specific requirements
  • The App will be compatible with all devices or operating system versions
  • The App will be uninterrupted, timely, secure, or error-free
  • Calculations or analyses will be accurate or reliable
  • Data loss will not occur
  • Defects will be corrected

You acknowledge that you use the App at your own risk and discretion.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Any financial decisions made based on the App or AI-generated insights
  • Errors, mistakes, or inaccuracies in calculations or content
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or other harmful code
  • Data loss or security breaches
  • Unauthorized access to your account

Maximum Liability:
Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months immediately preceding the claim, or €60.00, whichever is less.

Important: Some jurisdictions do not allow certain limitations. In such jurisdictions, our liability will be limited to the maximum extent permitted by law. Nothing in these Terms limits any non-waivable consumer protection rights you may have under mandatory laws, including EU consumer protection laws.


13. Financial Disclaimers

Not Financial Advice

Brim is a personal financial management tool, not a financial advisory service, bank, tax preparation service, or investment advisor. We do not provide personalized financial, investment, tax, or legal advice, and no professional relationship is created through your use of the App.

No Bank Integration

Brim does not connect to your bank accounts. All transaction data is manually entered by you. We do not access your bank accounts, import transactions automatically, verify balances, process payments, or hold, transfer, or transmit funds.

Your Responsibility

While we strive for accuracy, we make no guarantee that calculations are error-free or that budget projections are accurate. You are solely responsible for entering accurate data, verifying calculations, reviewing your actual bank statements, making informed financial decisions, and consulting with licensed professionals when appropriate.


14. Modifications to the Service and Terms

App Updates

We may update, modify, or discontinue the App or any features at any time to add new features, fix bugs, enhance security, ensure compatibility with new operating system versions, or comply with legal requirements.

Changes to Terms

We may modify these Terms at any time. When we make material changes, we will provide notice through the App, via email, or on our website, and update the "Last Updated" date at the top of these Terms. For changes that materially reduce your rights, we will provide at least 30 days' notice.

Acceptance of Changes:
Your continued use of the Service after changes become effective constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may delete your account.


15. Termination

Termination by You

You may terminate your use of the Service at any time by deleting the App from your device(s), canceling your subscription, or deleting your account through Settings → Account → Delete Account.

Termination by Us

We reserve the right to suspend or terminate your access to the Service if you violate these Terms, engage in fraudulent or abusive conduct, your payment method fails, we are required by law, or your account has been inactive for more than 24 months.

Effect of Termination:

  • Your license to use the App immediately terminates
  • You must cease all use of the App
  • Your local data remains on your device until you delete it
  • Your iCloud data remains in your iCloud account until you delete it
  • No refunds will be provided for any unused portion of a subscription period

16. Dispute Resolution and Governing Law

Governing Law

These Terms are governed by the laws of Belgium, without regard to its conflict of law principles.

Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the Service shall be brought exclusively in the courts located in Brussels, Belgium.

Informal Resolution First

Before initiating any formal legal proceedings, please contact us at hello@getbrim.app to attempt to resolve the dispute informally.

Consumer Rights

Nothing in these Terms limits any non-waivable consumer protection rights you may have under the mandatory laws of your jurisdiction, including consumer protection laws of the European Union and its member states.


17. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy (https://getbrim.app/privacy), constitute the entire agreement between you and Lazare Kolebka regarding the Service.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms to any successor or purchaser of our business or assets.

Notices

We may provide notices to you via email to the address associated with your account, through the App, or by posting on our website. You may provide notice to us at hello@getbrim.app.

Language

These Terms are drafted in English. In the event of any conflict between the English version and a translated version, the English version shall prevail.

Electronic Communications

By using the Service, you consent to receive electronic communications from us, including service announcements, administrative messages, and subscription-related notifications via email and in-app messages. These electronic communications satisfy any legal requirement for written communication.


18. Apple App Store Terms

Because Brim is distributed through the Apple App Store, the following terms apply:

Acknowledgment

You acknowledge and agree that:

  • These Terms are between you and Lazare Kolebka only, not with Apple Inc. ("Apple")
  • Apple has no obligation to furnish any maintenance or support services for the App
  • Apple is not responsible for addressing any claims you have relating to the App
  • Apple is not responsible for any third-party claims that the App infringes intellectual property rights
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you

Apple Terms Compliance

Your use of the App must comply with Apple's App Store Terms of Service, available at https://www.apple.com/legal/internet-services/itunes/us/terms.html.

20. Acceptance
